Do You Have An Android Phone? Seek Part of Google’s $135M Data Harvest Payment Soon

If you have Android phone and you live in the US, you may be eligible to claim part of the upcoming $135 million settlement. The lawsuit centers on allegations (PDF) that Google is “effectively coercing users to subsidize its surveillance by secretly programming Android devices to transmit user information regularly” using the same mobile data that customers purchased themselves.

The class action lawsuit Joseph Taylor v. Google (PDF) says that, starting in 2017, Google updated the Android OS to automatically collect mobile data. by the carriershas no way for users to log out. The lawsuit alleges that this data collection occurs even when people take steps like disabling it location tracking or close applications.

The lawsuit also makes another important allegation: that Google’s data collection practices constitute a crime called conversion. Extortion occurs when one party takes property from another with the intention of dispossessing it. No previous conversion case has ever paid as much as $135 million.

Google has denied wrongdoing, and the court did not rule that the company broke any laws. However, Google has agreed to settle with the class members, and the court has approved the settlement payment.

“We’re happy to settle this case, which unfairly changed the standard industry practices that keep Android safe. We’re providing more information to give people more information about how our services work,” said Google spokesperson José Castañeda.

The official payment website is now available, but the payment is subject to final court approval. The meeting is currently scheduled for June 23. The meeting will confirm the settlement amount, allocate attorneys’ fees and create a distribution plan to ensure that the money goes to eligible class members. Any changes to the schedule of the final ratification meeting will be reflected on the agreement’s website.

If you meet all of the criteria for class membership in this case, you are automatically eligible to receive a portion of the settlement payment sometime after the final approval hearing. Importantly, however, you are not guaranteed to receive any money unless you choose your preferred payment method on the payment website on June 23.

You can opt out of the settlement if you’d like to retain your right to sue Google over its alleged Android data collection practices separately, but you must do so by May 29, or you’ll be legally bound as a member of this settlement.

The case could have significant implications for data privacy and other data collection practices. It will also force a change in Google’s terms of service. The company has agreed to get clearer consent from Android users when it goes live new phonesto include a toggle button to disable certain types of data collection and to disclose data collection clearly.

Which Android users can be part of the Google settlement?

You may have an Android phone, but that doesn’t automatically make you eligible to claim money in this suit. Although the compensation and distribution system has not been confirmed, there is a clear framework that defines who is a member of the payment.

To join, you must meet all of the following criteria:

1. Be a resident of the United States or its territories.
2. Used a mobile phone with Android OS and mobile data plan anytime between Nov. 12, 2017 and final approval of this agreement.
3. He did not participate in the class action lawsuit Csupo v. Google LLC (PDF). This was a case that focused on similar allegations but only involved California residents. You cannot be a class member in both suits.

Affected individuals who meet these qualifications are automatically part of the settlement phase unless they opt out before May 29. Any updates will be posted on the settlement’s official website.

How much will Android data collection compensation pay?

While we do not know exactly how much each class member will be awarded in damages, there is an upper limit. Fees are around $100 per person, so don’t expect to get more than that.

A portion of the settlement money will be allocated to attorneys’ fees first, and the rest of the money will be distributed equally to the class members. If any money remains after the first round of distribution, it will be split into a second round of payouts to eligible members of the settlement class.

Even if you are a class member, you should still enter your preferred payment information using an official credit settlement website to ensure that the money will be distributed correctly.

Another solution involves the targeting of Google ads

This isn’t the only class action alleging that Google’s ad targeting practices crossed the line. Google recently agreed to an initial $68 million settlement in another case, this one involving Google Assistant (now replaced by Gemini Home).

Users suspect that smart devices used Google Assistant to listen in on them without them having to work, resulting in targeted ads based on information they didn’t voluntarily share. In that settlement, payments will be made automatically. No application form is required to receive payment.
